Terms & Conditions of Sale
Purchasing Policy & Agreement
Thank you for choosing JDR Metal Art. Because we build heavy-duty, custom-fabricated architectural products, it is important that you understand the terms of your purchase. By placing a deposit or order with us, you agree to the following terms and conditions.
1. Custom Orders & Design Approval
All Sales Are Final on Custom Work. Unlike buying a product off a shelf, your gate is built specifically for your driveway dimensions and style preferences. Once fabrication begins, the product cannot be restocked or resold to another customer.
-
Design Process: For custom designs, we will provide a CAD (Computer-Aided Design) drawing for your approval. It is the customer’s responsibility to verify all dimensions, spelling (for names/signs), and design details in this drawing.
-
Approval: Once you approve the final design (via email or signature), JDR Metal Art is not responsible for errors in the approved design, including incorrect dimensions provided by the customer.
2. Payment Terms
-
Deposit: A non-refundable deposit (typically 50%) is required to secure your spot in our fabrication schedule and order materials.
-
Balance Due: The remaining balance must be paid in full upon completion of fabrication and prior to shipping. We cannot release the crate to the freight carrier until the final invoice is satisfied.
-
Method: We accept major credit cards, checks, and bank transfers.
3. Cancellations & Refunds
-
Before Fabrication: If you cancel your order after the design work has started but before metal has been cut, a cancellation fee (to cover design time and administrative costs) may be deducted from your deposit refund.
-
After Fabrication Begins: Once metal has been cut or ordered specifically for your project, deposits are non-refundable.
-
Returns: We do not accept returns on custom gates, posts, or artwork.
4. Lead Times
-
Estimates Only: Any completion date provided is an estimate, not a guarantee. Custom metalwork is subject to variables such as material availability, powder coat curing times, and workload.
-
Delays: JDR Metal Art is not liable for any consequential damages or costs (e.g., contractor scheduling) resulting from production or shipping delays. We advise customers not to schedule installation contractors until the gate has physically arrived at your property.
5. Shipping & Receiving (Critical)
We may either deliver your driveway gate or ship it to you via freight, depending on a variety of factors such as distance and current workload. We take extreme care to crate and protect your gate (refer to our Shipping Page for details). However, once the freight leaves our facility, it is in the hands of the carrier.
-
Customer Responsibility to Inspect: YOU MUST INSPECT THE CRATE UPON ARRIVAL.
-
Visible Damage: If the crate arrives with visible damage (broken wood, torn packaging), you must note it on the Delivery Receipt (Bill of Lading) before the driver leaves.
-
Concealed Damage: We recommend opening the crate as soon as possible. If you find damage to the gate, you must notify JDR Metal Art within 48 hours of delivery to file a claim.
-
Unloading: The customer is responsible for having the necessary equipment (forklift, tractor, or manpower) to offload large gates from the truck, unless “Liftgate Service” was pre-arranged for smaller items.
6. Installation & Liability
JDR Metal Art is a manufacturer, not an installer (unless explicitly contracted otherwise).
-
DIY / Third-Party Install: We are not responsible for damage, injury, or malfunction caused by improper installation by the customer or a third-party contractor.
-
Code Compliance: It is the customer’s responsibility to ensure their gate design complies with local building codes, HOA regulations, and fire department access requirements.
-
Gate Openers: While we can recommend automation systems, we are not responsible for the electrical wiring or programming of these units on-site.
7. Intellectual Property
All custom designs, drawings, and artistic concepts created by JDR Metal Art remain the intellectual property of JDR Metal Art. We reserve the right to use photos of your finished gate for marketing and portfolio purposes unless a non-disclosure agreement is signed prior to production.
